Former Atlanta Police officer who assaulted our client convicted of aggravated battery
icholas Dimauro, a former Atlanta Police Department officer, was recently convicted of aggravated battery and violation of oath of office. Dimauro was sentenced to serve five years in prison and five years on probation.
The Fulton County District Attorney’s Office opened an investigation into Dimauro after one of our clients filed suit against him, the City of Atlanta and other officers, as a result of Dimauro and the other officers repeatedly punching and kicking him, despite the fact he was not resisting arrest. The officers knocked several of our client’s teeth out and broke several of his other teeth. Our investigation of that case revealed that Dimauro had seventeen prior citizen complaints against him for using excessive force. One of those incidents, Dimauro’s savage beating of Robert Wormley, resulted in his recent conviction.
According to documents and reports regarding that incident, Dimauro stopped Mr. Wormley, a pedestrian who was walking home, without reason to suspect he was engaged in any sort of criminal activity. Dimauro demanded that Mr. Wormley show his identification and, when Wormley refused, ordered Wormley to put his hands on Dimauro’s police vehicle. When Wormley again refused to comply and started to attempt to get away from Dimauro, Dimauro chased him down and repeatedly struck him in the head with an ASP baton. Dimauro beat Mr. Wormley so badly that Wormley was left with a broken arm, two broken ribs, broken teeth, a collapsed lung and a large gash across his head.
